These Terms of Service ("Terms") govern your use of semperfishing.net and the Semper Fishing mobile apps for Android and iOS (together, the "Service"), operated by Semper Fishing from Muskegon, Michigan, USA ("Semper Fishing," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility & Accounts
You must be at least 13 years old to create an account. The Service is not directed at children under 13 and we do not knowingly collect their data (see our Privacy Policy).
You're responsible for keeping your account credentials secure and for all activity under your account. Provide accurate information when you register (name, email). You may sign in with email, Google, or Sign in with Apple. You can delete your account at any time from your account settings or by emailing [email protected]. We may suspend or terminate an account that violates these Terms, is used fraudulently, or is used to abuse the Service (see Section 6, Prohibited Conduct).
2. Content You Submit
"Your Content" means anything you upload, post, or submit through the Service — catch photos and videos, catch details (species, weight, length, location, story), trip reports, comments on other anglers' catches, and anything else you contribute. You keep ownership of Your Content. We don't take it from you, and this section is not a transfer of ownership.
License grant. By submitting Your Content and choosing to share it (for example, logging a catch with "share to spot" enabled, or posting a comment), you grant Semper Fishing a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute Your Content solely for the purpose of operating, displaying, promoting, and improving the Service — for example, showing your catch photo on a spot page, in the public catch feed, or in app store screenshots and marketing that showcase real catches on the platform.
This license is revocable. When you delete a catch, comment, or your account, we stop displaying that content and the license ends for future use. Content already cached by a CDN, search engine, or a screenshot/download taken by another user before deletion is outside our control and this license does not cover that. Content you never opt to "share to spot" or make public stays private to your own catch log and is not covered by the public-display portion of this license.
Your warranty. By submitting Your Content, you represent and warrant that: (a) you own it or have all rights and permissions necessary to submit it and grant the license above; (b) it does not infringe any third party's copyright, trademark, privacy, publicity, or other rights; and (c) it does not violate any law, contain illegal content, or depict illegally taken fish (over-limit, out-of-season, protected species, or otherwise contrary to your state's fishing regulations).
Moderation. Content shared publicly (catches marked "share to spot," comments) is reviewed before or after publication. We may approve, reject, remove, or hide any content at our discretion — including content that appears to violate these Terms, appears fraudulent, or is the subject of a valid takedown request — without notice.
3. Copyright & DMCA / IP Complaints
We respect intellectual property rights and expect our users to do the same. If you believe content on the Service infringes your copyright or other intellectual property rights, send a notice to our designated contact:

To be effective, your notice should include, at minimum:
- Your physical or electronic signature (typed full name is sufficient);
- Identification of the copyrighted work or other right you claim has been infringed;
- Identification of the specific material you claim is infringing, with enough detail (a URL or a description of where it appears on the Service) for us to locate it;
- Your contact information — address, phone number, and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Upon receiving a valid notice, we will remove or disable access to the reported content. If you believe your content was removed in error, you may send a counter-notice to the same address identifying the removed content and stating, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification. We may restore the content if the original complainant does not pursue further action within a reasonable time.
We may terminate the accounts of users determined to be repeat infringers.
4. Freemium Tiers, Subscriptions & Purchases
The Service offers a free tier ("Shore Pass") and a paid subscription tier ("Pro Angler"), plus one-time AI-trip token packs. Current pricing, limits, and features are listed on our Pricing page and are subject to change with notice on that page.
- Free tier. Includes a limited number of AI trip plans, AI Fish IDs, and catch logs per month, which reset monthly. Limits are enforced server-side and may be adjusted over time.
- Pro Angler subscription. Billed monthly or annually in advance, auto-renewing until cancelled. On the web and in the Android app, subscriptions are processed by Stripe. In the iOS app, subscriptions are processed by Apple through the App Store's in-app purchase system (via RevenueCat), per Apple's requirements for digital subscriptions on iOS. You can cancel anytime from your account page (web/Android) or through your Apple ID subscription settings (iOS); you keep Pro access through the end of the current billing period, then revert to the free tier.
- Token packs. One-time, non-subscription purchases of additional AI trip credits. Tokens never expire and are non-transferable between accounts. Token packs are non-refundable except as required by law or by the applicable app store's refund policy (Stripe purchases: contact us; Apple purchases: refunds are handled by Apple per their policies, not by us).
- Billing disputes & refunds. For Stripe-billed purchases, contact [email protected]. For Apple/App Store purchases, refunds must be requested through Apple, since Apple — not Semper Fishing — processes and holds that payment.
5. Acceptable Use
You agree not to:
- Scrape, bulk-download, or systematically extract data from the Service beyond normal personal use;
- Attempt to bypass usage limits, rate limits, or paid-feature gates by any technical means;
- Upload content that is illegal, defamatory, harassing, sexually explicit, or that depicts illegal fishing activity;
- Impersonate another person or misrepresent your affiliation with any person or entity;
- Use the Service to violate any applicable fishing, wildlife, or boating law or regulation;
- Interfere with or disrupt the Service, including probing, scanning, or testing its vulnerability, or attempting to gain unauthorized access to any account, system, or network.
6. Prohibited Conduct & Enforcement
We may remove content, restrict features, suspend, or terminate accounts that violate these Terms, at our discretion, with or without notice. Fraudulent payment activity (chargebacks, stolen cards) will result in immediate termination and forfeiture of any associated Pro access or tokens.
7. Third-Party Data & Regulations Disclaimer
Semper Fishing aggregates public data (access points, species information, regulations, water gauge and weather data) from public and third-party sources and provides it as a convenience. We are not affiliated with any state DNR, wildlife agency, or the USGS/NOAA. 8. Disclaimer of Warranties
The Service, including AI-generated trip plans and AI Fish Identifier results, is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated content (trip plans, fish species identification) can be wrong or incomplete — verify species identification and regulatory compliance independently before acting on it, especially where legality or safety is involved (e.g., protected species, slot limits, ice/water safety).
9. Limitation of Liability
To the fullest extent permitted by law, Semper Fishing and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of (or inability to use) the Service — including reliance on trip plans, species identifications, regulation summaries, or water/weather data. Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or $50, whichever is greater. Some jurisdictions don't allow certain limitations of liability, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold Semper Fishing harmless from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your violation of these Terms, or your violation of any law or third-party right.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or extended inactivity affecting shared data integrity. Sections that by their nature should survive termination (content license limits already granted to third parties before deletion, warranties, indemnification, limitation of liability) will survive.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent change. Material changes will be announced via email or an in-app/on-site notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles, except where local consumer-protection law provides otherwise.
